Fines for Failing to Comply

The person liable for this fine is the one who is named on the lease agreement as being the person who is letting the property, so it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed. It should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It’s also important to keep in mind that a landlord with multiple rental properties may face more severe penalties for not complying. The highest penalties are handed down only for serious violations, and landlords who own six or more properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement throughout Fernhill and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records of their the compliance with the Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

Starting 1 July 2021

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.
