Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for a Havelock North Central rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on the Havelock North Central rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet each of Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy contract, there could be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or the property manager doesn’t supply the necessary information within 21 days of getting the notice, the tenant can receive an infringement notification and be fined up to $750.

Furthermore, there’s an additional fine of up to $900 for landlords or property managers who offer a false or false Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the one who is listed on the tenancy contract as the person leasing the property out and it could be the name of the landlord or the company that manages the property.

All information in the Compliance Statement needs to be current when the tenancy agreement is executed, and it is updated through the tenancy period as necessary work related to it is finished.

It’s important to note that landlords who own several rental properties can face greater penalties for non-compliance. The harshest penalties are given for serious breaches. Landlords with more than six properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Havelock North Central Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory to all Havelock North Central and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with any Healthy Homes Standards that apply or will apply during the tenancy of your rental home.

Starting 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Heating Havelock North Central

Havelock North Central rental properties need to have a stable heating source that can warm the principal or the biggest living area to at minimum 18degC, even during the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to remain fixed (i.e. not portable) with at least 1.5 kW of heating capacity and have the minimum capacity for heating required to heat the living space in general. The Heating Assessment Tool can be used to determine whether the current permanent heater(s) are adequate or whether you will need to "top-up" with a new heater. Open fires as well as unflued combustion heaters, such as mobile LPG bottle heaters aren’t considered acceptable heating options under the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it should be equipped with the thermostat. This will help make the heating more reliable and efficient. For most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In some instances, like small apartments an electric, fixed heater might be enough.

If your main living space already has a fixed heating source, such as heat pumps, it could need some additional energy to ensure it meets the requirements. Some types of heaters can’t be utilised to meet the standard since they’re either costly, not cost-effective to run, and/or unsafe to run.
