Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Mangateretere rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

The person who is responsible for this fine is the one who is named on the lease agreement as the one who is leasing the property out which could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be up-to-date when the tenancy agreement is executed, and it must be updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is important to remember that a landlord who have several rental properties can face even higher fines for non-compliance. The most severe penalties are given for severe violations, and landlords who own more than six properties could be fined up to $50,000, or as high as $100,000 for hearing claims.

Mangateretere Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory in all Mangateretere and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will be in force to the rental property.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties comply with the Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Heating Mangateretere

Rental properties in Mangateretere must have a fixed heating source that is able to heat the{ main or largest|| largest or main| principal or the biggest} living space to at least 18degC, even on the coldest days of the year.
