Fines for Failing to Comply
From the 1st of July in 2021, when a brand new or renewed contract is signed on a Pirimai rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy contract, there could be an additional penalty or infringement fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not provide the information requested within 21 days from receiving the request, they may receive an infringement letter and could be fined up to $750.
Additionally, there is also a fine of approximately $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the person who is identified on the tenancy agreement as being the person leasing the property out, so it could be the name of the landlord as well as the property management company.
All information in the Statement of Compliance needs to be up-to-date when the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any relevant work gets completed.
It’s also important to note that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The most severe penalties are given for serious breaches, and landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 in hearing claims.
