Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Poraiti rental property, all Healthy Homes compliance work must be finished within 90 days.

All information in the Statement of Compliance needs to be correct when the tenancy contract is completed, and is updated throughout the duration of the tenancy when any associated work has been completed.

It is important to be aware that landlords with several rental properties can face even higher fines for non-compliance. The harshest penalties are handed down for severe breaches, and landlords with at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

Poraiti Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is required in all Poraiti and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records of their the conformance to any Healthy Homes Standard that apply or will be applied to the rental property.

Beginning 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Rental properties in Poraiti need to have a stable source of heat that can heat the principal or the biggest living room to at least 18degC, even during the coldest days of the year. In most homes, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In certain situations, such as small apartments, a smaller fixed electric heater may suffice.

If the living area already has a permanent heating source such as the heat pump, it might just need an upgrade to be able to meet the standards. Certain types of heaters cannot be used to meet the quality because they’re expensive, inefficient or unsafe to operate.
