Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Roys Hill rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

As of 1st July 2021, when a new, renewed or varied Tenancy is signed for a Roys Hill rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or amended tenancy agreement there could be additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to supply the necessary information within 21 days of being informed of the request, they could receive an infringement notification and be fined as high as $750.

In addition, there’s an additional fine of up to $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible to pay this fine is the one who is named on the lease contract as the person leasing the property out which could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be current when the tenancy contract is executed, and it should be kept updated during the entire tenancy, as relevant work gets completed.

It is also important to note that landlords who own multiple rental properties may face even higher fines for non-compliance. The harshest penalties are given only for serious breaches, and landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 in hearing claims.

In the end, a failure to adhere to the Healthy Homes requirements can hit your pocket with significant fines and continuing to be required to comply with the requirements. Don’t risk your rental property Call us today and arrange to have a home assessment performed for your rental property.

Adequate heaters are crucial for healthy houses

Heating Roys Hill

Rental properties in Roys Hill require a reliable source of heating that is able to heat the{ main or largest|| largest or main| principal or the biggest} living area to at minimum 18degC, even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source requirements to remain fixed (i.e. not portable), at least 1.5 Kilowatts in heating capacity and have the minimum required heating capacity for the main living space. A Heating Assessment Tool may be used to check if the current installed heater(s) are adequate or whether you will require to "top up" by adding a second heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters are not considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating that you offer is electric heating or heat source, it must have a thermostat. This makes the heating more uniform and effective. For most properties, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in certain instances like small apartments the smaller fixed electric heater may be sufficient.

If your main living space already has a fixed heating source such as an air conditioner, it might require a top up to ensure it meets the requirements. Certain kinds of heaters aren’t able to be used to comply with the quality since they’re either expensive, inefficient or are unsafe to operate.
