Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Roys Hill rental property, all Healthy Homes compliance items must be taken care of within 90 days.

As of 1st July 2021, if a new or renewed lease is entered into on a Roys Hill rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy agreement, it could result in an additional fine or violation fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to supply the information requested within 21 days of receiving the request, they could receive an infringement letter and be fined as high as $750.

In addition, there is also a penalty of up to $900 for landlords or property managers providing a false or false Healthy Homes Compliance Statement or any other information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as being the person renting the property, so it could be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be accurate before the tenancy agreement can be completed, and is updated during the entire tenancy, as related work is completed.

It is important to remember that a landlord who manage multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved for severe breaches, and landlords with at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Roys Hill Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement throughout Roys Hill and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to the Healthy Homes Standard that apply or will be applicable to the rental property.

From 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Rental properties in Roys Hill require a reliable heating source which can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the most coldest days of the year.
