Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a St Leonards rental property, all Healthy Homes compliance work need to be finished within 90 days.

From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for the St Leonards rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or revised tenancy contract, there may be an additional fine or violation fee.

If the landlord or property manager is unable to provide the necessary information within 21 days of receiving the request, they may receive an infringement notification and be fined up to $750.

In addition, there is also a penalty approximately $900 for property owners or property managers providing a false or false Healthy Homes Statement of Compliance or information. The person who is liable to pay this fine is the one who is named on the tenancy agreement as being the person leasing the property out which could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be current when the tenancy contract is completed, and must be updated through the tenancy period as necessary work related to it is finished.

It is crucial to remember that a landlord who have multiple rental properties may receive more severe penalties for not complying. The harshest penalties are handed down for severe violations. Those who have more than six properties could be penalised up to $50,000, and as much as $100,000 in hearings.

St Leonards Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is compulsory for all St Leonards and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating St Leonards

Rental properties in St Leonards must have a fixed source of heating that is able to heat the principal or the biggest living room to at least 18degC, even on the coldest winter days.
