Fines for Failing to Comply
As of 1st July 2021, once a new or renewed contract is signed on a Tamatea rental property, all Healthy Homes compliance work have to be completed by the end of 90 days.
Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Tamatea rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Inability to adhere to all of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy contract, there could be an additional fine or infringement fee.
Any tenant may request details about the Healthy Homes Standard and how they relate to the property they reside in. If the the property manager doesn’t provide the required information within 21 days from having received the inquiry, they may receive an infringement notification and could be fined up to $750.
In addition, there is an additional fine of up to $900 for landlords and property managers that provide false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is listed on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord or the company that manages the property.
The information contained in the Compliance Statement requirements to be correct when the tenancy contract is signed, and ideally it should be maintained during the entire tenancy, as necessary work related to it’s finished.
It is also important to remember that landlords who manage several rental properties can face even higher fines for non-compliance. The most severe penalties are handed down for serious breaches, and landlords with six or more properties could receive fines of up to $50,000 and as high as $100,000 for hearing claims.
