Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Waipatu rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Waipatu rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they live in. If the property manager fails to provide the required information within 21 days from having received the inquiry, they may receive an infringement notice and be fined upto $750.

Furthermore, there’s also a penalty approximately $900 for landlords and property managers who provide a false or false Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the one who is named on the tenancy agreement as the one who is renting the property which could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be up-to-date when the tenancy agreement is signed. It must be updated throughout the tenancy as any related work is completed.

It’s also crucial to note that landlords who own multiple rental properties could face more severe penalties for not complying. The most severe penalties are reserved for serious violations, and landlords who own more than six properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

When should I need to meet The Healthy Homes Standards?

Waipatu Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory in all Waipatu and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records of their the compliance with each Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

From July 1st 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed , or altered lease.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Draughts are a major cause of low temperatures inside households. A draughty home will cost more to heat, meaning wasting energy and resulting in higher bills.

What are unreasonable gaps or holes?

If you are able to feel external air coming in or a clear draught from a gap or hole, then it is most likely a gap or hole that requirements sealing in any way. Cracks or gaps with large gaps must be stopped permanently. Gaps greater than 3mm that let air into or out of the house need the sealing. For example, if the open fireplace isn’t being used, it can create draughts. This must be sealed from. Heating Waipatu

Rental properties in Waipatu require a reliable source of heat that can heat the largest or main living room to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements to remain fixed (i.e., not portable), at least 1.5 horsepower in capacity, and must meet the minimum heating capacity needed for the main living space. The Heating Assessment Tool can be used to determine whether the current fix heater(s) are sufficient or if you’ll need to ‘top up’ with a new heater. Fires that are open and unflued heaters such as the portable LPG bottle heaters are not considered to be acceptable heating options for the Healthy Homes Standard.

If the heating that you offer is an electric heater or heat pump, it must include an thermostat. This will help make the heating more reliable and effective. For the majority of houses, bigger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. In certain situations, such as small apartments the smaller fixed electric heater could be enough.

If the main living room already has a fixed heating source, such as a heat pump, then it could require some additional energy in order to comply with the standards. Some types of heaters can’t be used to comply with the quality because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Waipatu

Every living space of a rental house must have at least one openable window or exterior door to provide natural ventilation. In addition, high moisture areas such as kitchens and bathrooms should be equipped with an venting fan outside to remove moisture.

Insulation Waipatu

Ceiling and underfloor insulation is required in all rental houses from 1 July 2019. Property managers and landlords must ensure that the insulation meets the new quality. In certain situations, the old ceiling insulation as well as insulation within the subfloor space may require to be replaced or replaced.
